Odstock Parish Council

An Ordinary meeting of Odstock Parish Council is scheduled to be held on 6 September 2012 in The Radnor Hall, Bodenham.
Present: Rod Poynting (Chairman), Colin Berry, Stephen Stapley, Nigel Start, David Williamson-Jones, Gavin Simmonite, Richard Parsons (Clerk), Wiltshire Cllr Julian Johnson and one member of the public.
Apologies: Ray Martin (Vice-Chairman).

25/12 Open Public Forum: Issues raised by Parishioners included:
1. Ineffective drainage ditches on the road to Odstock Hospital and on the road between Nunton and Odstock:

3. Is there a need for roadside footpaths near Odstock School? 

26/12 Declaration of Interest: None.

27/12 Minutes of the Annual PC meeting held on 10 May were agreed and signed by the Chairman. 

28/12 Nunton Recreation Field:
a) Electrical Repairs:
As the result of a fault discovered in the Pavilion electrics, a supplementary electrical survey was undertaken and repairs effected. 
b) Play Area Safety Inspections: Regular inspections are being undertaken and records maintained.

29/12 Community Initiatives:
a) Radnor Hall Committee:
The Chairman reported that the Landfill Community Fund, with the Odstock, Nunton and Bodenham Fete Committee acting as the Third Party Funder, had awarded a grant of £3,000 towards the kitchen refurbishment project. 
b) Odstock Recreation Field: Cllr Simmonite is now seeking the funding necessary to action the proposed Play Area project at the western end of the field. Ref: OPC min no.49/11(b)
c) Odstock Telephone Kiosk: Cllr Berry reported that he had been attempting to discover British Telecom's plans for the redundant phone box, which OPC has committed to adopt. Ref: OPC min no.22/10(b)
d) Diamond Jubilee Grant Award: This grant had contributed to the provision of commemorative mugs.
e) River Banks at Jubilee Gardens: The Chairman reported that the Flood and Coastal Risk Management Dept. of the Environment Agency had granted a licence for the project to proceed, that the Southern Wiltshire Area Board had agreed to act as the project's Third Party Funder with a grant of £223 from the Community Area Grants Fund and that the Landfill Community Fund had subsequently awarded a grant of £2,000. With £1,140 from OPC reserves, the project is now fully funded. Ref: OPC min no.18/12(f). 
f) Notice Board Refurbishment: Cllr Start reported that he had completed the Odstock Notice board and trimmed the hedge in the immediate vicinity.

30/12 Transport, Roads and Footpaths:
a) Parish Maintenance Issues:
The retiring OPC Highways Coordinator forwarded his last report to the Wiltshire Highways Steward soon after the OPC meeting in May. OPC will now seek a volunteer within the Parish to take over as OPC Highways Coordinator. In the meantime all Highway issues can be reported to Wiltshire Council's 'Clarence' freephone number: 0800 23 23 23.
b) Avon Valley Footpath: Cllr Berry reported that the Wiltshire Council Rights of Way Officer is seeking volunteers to help with the installation of kissing gates. OPC has committed £800 towards the cost of 8 gates.
c) Footpath between Odstock Church and Nunton: Cllr Berry reported that he had enquired of Wiltshire Highways about resurfacing the footpath behind the hedge. He had been advised that this could be considered in the next financial year.
d) Community Speed Watch: Cllr Start agreed to explore the feasibility of setting up a group of volunteers to receive training for Community Speed Watch.

31/12 Planning: There were no planning applications to consider.

32/12 Reports and Correspondence:
a) South Wiltshire Area Board:
The last meeting in Alderbury Village Hall on 26 July, attended by the Clerk.
b) South Wiltshire Area Board: The next local meeting is in Pitton Village Hall on 27 September followed by Coombe Bissett Village Hall on 29 November.
c) Police Neighbourhood Bulletin: No reported crime.

33/12 Finance:
a) Proposed Play Area in Odstock:
It was agreed to set aside £5,000 from reserves to pay for this project.
b) Existing Code of Conduct: The code of conduct adopted by OPC to satisfy its duties under s.51 of the Local Government Act 2000 ceased to have effect on 1 July 2012 (paragraph 56 of schedule 4 of the 2011 Act). An undertaking to comply with a code of conduct given by a person under s.52 of the Local Government Act 2000 or as part of a declaration of acceptance of office in a form prescribed by order under s.83 of the Local Government Act 1972 ceased to have effect when the parish council's existing code ceased to have effect.
c) Revised Code of Conduct: The Localism Act 2011 (Commencement No.6 and Transitional, Savings and Transitional Provisions) Order 2012 ('the 2012 Regulations'), brought into force on 7 June 2012, confirmed that a parish council must, pursuant to s.27 of the 2011 Act, adopt a new code of conduct which complies with the provisions of s. 28 of the 2011 Act to take effect on or after 1 July 2012. The 2012 Regulations also confirm that on 1 July, a member of a parish council is at risk of prosecution for committing criminal offences in s.34 of the 2011 Act if: -
a. he/she, without a dispensation, participates or votes on a matter being considered at a meeting in which he/she has a 'disclosable pecuniary interest' (s.31(4) of the 2011 Act) or
b. written notification of such disclosable pecuniary interest has not already been given to the Monitoring Officer, and the member does not disclose the disclosable pecuniary interest to the meeting and does not provide written notification of the interest to the Monitoring Officer within 28 days of the meeting (ss.31(2) and (3) of the 2011 Act) or
c. he/she knowingly or recklessly provides false or misleading information about the above (s.34(2) of the 2011 Act). 
d. Odstock Parish Council adopted the new Code of Conduct on 6 September 2012 with members completing a Notice of Disclosable Pecuniary Interest to be submitted to the Monitoring Officer.
